Project Payments

• 50% deposit required to begin project work
• Remaining balance due upon project completion
• Payment plans available for qualified clients
• All payments are non-refundable once work has begun

Ongoing Services

• Monthly services billed in advance
• Payments due on the same date each month
• Late payments may result in service suspension
• 30 days written notice required for cancellation

The Total Presence Plan

• One-time setup fee and first month's subscription due at signing; automatic monthly payment required thereafter
• 6-month minimum term. If you cancel before completing 6 paid months, the remaining balance of the minimum term becomes due
• The setup fee is refundable within 30 days of signing if you cancel before approving your website design. Claiming this refund cancels the plan; it does not shorten an active minimum term
• After the minimum term, cancel anytime with 30 days written notice

Additional Work

Work beyond the original scope will be quoted separately and requires written approval before proceeding. Hourly rates apply for small changes.

Client Content

You retain all rights to content, images, and materials you provide. You grant us permission to use these materials for your project and promotional purposes unless otherwise specified.

Custom Website Builds (Project-Based Work)

For project-based Custom Website Builds: upon full payment of the agreed project price, you own the custom website design and content created specifically for your project. We retain rights to underlying code frameworks, tools, and methodologies developed by our company.

Total Presence Plan Websites

Websites built under The Total Presence Plan are licensed to you for the duration of your active subscription — your monthly fee covers ongoing service, hosting, and marketing, not the full cost of the website build. Ownership transfers as follows:

• After 12 paid months: full ownership of your website transfers to you at no additional charge
• Between months 6 and 12: you may purchase your website for a one-time buyout of $1,200
• Migration options once the site is yours: a managed migration (we handle DNS, deployment, and handoff to your new host) for a flat $600, or a free self-serve handoff of the code repository, provided as-is. The self-serve handoff requires your own developer to deploy and does not include our hosting infrastructure, email services, forms, backend services, or support
• Regardless of plan status, your domain name and Google Business Profile are always your property. Domains are registered in your name and transferred to you free of charge upon cancellation; you remain the owner of your Google Business Profile with our team acting only as a manager
• We retain rights to underlying code frameworks, tools, and methodologies developed by our company

Portfolio Use

We reserve the right to display your completed project in our portfolio and marketing materials unless you specifically request otherwise in writing.

Service Warranty

We warrant that services will be performed in a professional manner consistent with industry standards. We will correct any defects in our work at no charge for 30 days after project completion.

Limitation of Liability

Our liability is limited to the amount paid for services. We are not responsible for indirect damages, lost profits, or business interruption. We maintain professional liability insurance for additional protection.

Third-Party Services

We are not responsible for issues with third-party services (hosting, domain registration, payment processors, etc.) but will assist in resolving problems when possible.

Client Termination

You may terminate services with 30 days written notice, subject to any minimum term in your plan. For project-based Custom Website Builds, you will receive all completed work and source files upon payment of outstanding invoices. For The Total Presence Plan, website ownership and handoff are governed by Section 5 (Intellectual Property).

What Happens When Your Plan Ends

When a Total Presence Plan subscription ends, the services it includes end with it: hosting, business email, the lead dashboard, SEO work, social media posting, Google Business Profile management, and content updates. To ensure your business never goes dark, we provide:

• A 30-day wind-down period during which your website remains live while you transition
• A free export of your content: page copy, images, and lead/form submissions
• Free transfer of your domain and Google Business Profile ownership (which were always yours)

Company Termination

We may terminate services for non-payment, breach of terms, or if the working relationship becomes untenable. We will provide reasonable notice and transition assistance.
